CONDITIONS FOR SALE
For the purpose of this contract and conditions of sale, DB PROPERTY MAINTENANCE . shall be referred to as ‘the Company’ and ‘the Customer’
will be taken to refer to the name written overleaf.
1. Quotations are given on the understanding that:-
(a) The terms/prices quoted are those that are applicable at the time and will be held firm for a period not exceeding 30days from the date of the
Quotation. Quotations not accepted within 30 days automatically become null and void.
(b) V.A.T.or any other form of duty is charged as applicable at the rate which is current at the date and tax point of the contract.
2. When we have carried out our survey and your order is being processed should cancellation in exceptional circumstances be accepted we reserve the right
To claim up to 55% of the contract value.
3. All contracts shall be between the Company and the Customer. There shall be no separate agreement between the customer and the company’s agent or
representative in regard to the goods or their installation.
4. No variation, cancellation or waiver of these conditions shall be valid unless made in writing from the Company’s main office.
5. Typographical and/or clerical errors or omissions shall be subject to correction.
6. All drawings and illustrations in the Company’s catalogues, sales and promotional literature or elsewhere are intended as a guide only and may not be to
scale.
7. Order are accepted on the basis that the manufacturing process shall commence within two months from the date of acceptance.
Where this is not possible due to the customer requesting an extended delivery or installation the Company reserves the right to vary the price accordingly.
8. The Company’s acceptance of supply and installation orders is subject to a surveyors inspection, on the result of which the Company reserves the right to re
Refund any monies paid and refuse to accept the Customer’s order. During the course of such survey there may be disturbances to decorations and fittings
and the Company shall not be responsible for making good such disturbances should such refusal ensue due to technical reasons.
9. Any special wall or floor finish, tiling etc., must be notified to the Technical Surveyor at Survey stage and noted on the plan, otherwise no liability for floor
Or wall fitments can be accepted by the Company if they effect such finish.
10. The period quoted for delivery/and/or/installation commences from the date of the contract but is an estimate only. Whilst the Company shall use
reasonable commercial endeavors to deliver and install the goods by the estimated date specified it shall not be liable in any way for delay in delivery
or installation. Time shall not be the essence.
11. For surveying and installation purposes the customer hereby agrees to allow:-
(i) Access during normal working hours.
(ii Reasonable free use of electricity and water.
12. The customer shall be responsible for:-
(i) Moving all free standing furniture, emptying existing units which are to be removed and removing general household effects from the area in which
the work is to be carried out.
(ii) Making good any decorations which have been disturbed during installations and which do not form part of the contract.
(iii) Removal of any debris, packing materials or existing units unless other arrangements have been made with the Company.
13. Cheques shall be crossed and made payable to DB Property Maintenance cheques are accepted.
Payments with order may be handed to the Company’s accredited representative but a signed receipted copy of the order
Must be retained by the Customer.
At the time of completion of the installation any balance payment shall be handed to the Company’s installer and a receipt obtained.
14. Goods dispatched direct to the customer must be accepted on arrival. Non acceptance will render the customer liable for an additional charge for delivery.
15. Should any event occur which is beyond the control of the Company e.g. strike, war, fire, flood, drought or other act of God and the performance of the
Contract is prevented or delayed the company reserves the right to suspend delivery or other performance of its obligations under any contract. If such
prevention or delay continues for three months, thereby so extending the anticipated delivery period, the customer may elect to cancel the contract or
allow the order to remain on the Company’s books to be completed at some later date.
16. All units and unit surfaces are guaranteed for a period of 1 years after the date of installation by DB Property Maintenance subject to
normal wear and tear.
Appliances and all sanitary ware items are subject to the various manufacturers terms of guarantee.
No manufacturer of ceramic wall or floor tiles guarantee their product against crazing.
Any defects found after installation must be reported to the Company within 7 days.
17. Fit only all materials are supplied by customer any delays due to missing items or work over running because of extra works will be result in a £185 for each day delayed
18.All goods the subject of this contract shall remain the property of the Company (but shall be at the risk of the purchaser from the date of delivery) until such time as full payment has been made, whether Cash, Finance or Building Society Mortgage. In the event of full payment not being made the Company
will be entitled to unfix and remove all materials , equipment and appliances supplied by them and to offer the same for resale without liability for
Compensation to the purchaser .Any payments received by the Company prior to the terms of this clause being put into effect will be forfeited to the Company.
19. subcontract work must be paid within 14days unless agreed to 30 days
